Rights and Responsibilities on Farm

The Occupational Health and Safety Act outlines the rights of all workers in Ontario. They include: the right to know, the right to participate, and the right to refuse. The right to know is that workers have the right to know about any potential hazards they may be exposed to in the workplace. It includes that they should be informed and instructed how to protect their safety. This also includes health and safety relating to the use of machinery and equipment, substances, and working conditions. Furthermore, part of this right is that employees are provided with health and safety training. The right to participate is that workers have the right to be involved in workplace health and safety. This includes participation in health and safety in the workplace and can include worker health and safety representatives. The right to refuse means that workers have the right to refuse any work they believe to be dangerous and put their safety at risk. Workers cannot be fired or disciplined for refusing unsafe work. It is essential that both employers and workers are familiar with the Occupational Health and Safety Act and are aware of their rights and responsibilities. Under the Occupational Health and Safety Act the employer is tasked with certain responsibilities. These include:

  • Establishing a health and safety committee or allowing workers to select at least one health and safety representative
  • Taking every reasonable precaution to ensure a safe workplace
  • Training employees about potential hazards and what to do in an emergency
  • How to use equipment properly and safely
  • How to use any necessary personal protective equipment
  • Reporting all critical injuries
