In most cases when lot creation or a new residential or industrial land use is proposed to a township, the landowner is responsible to have a qualified individual complete an MDS I assessment.

Where there are no livestock barns on a lot, MDS calculations shall be based on the combined design capacity for all manure storages on a lot, even if they are unused manure storages or separated by a substantial distance on the lot.
As part of municipal consideration of planning or building permit applications, all existing livestock facilities, or anaerobic digesters within a 750 m distance of a proposed Type A land use and within a 1,500 m distance of a proposed Type B land use shall be investigated and MDS I setback calculations undertaken where warranted.
MDS calculations shall be based on the combined design capacity for all livestock barns on a lot, even if they are unoccupied livestock barns or separated by a substantial distance on the lot.
MDS II Information
MDS II provides the minimum distance separation between proposed new, expanding or remodeling livestock facilities and/or permanent manure storage facilities.
Calculations must be completed when building or expanding livestock facilities.
Landowners must keep in mind that a minor variance application may be required if you are not able to meet the required MDS II distances, this can significantly affect a project timeline.
Existing livestock barns on a property will decrease the future setbacks for expanding the livestock facility or manure storage on that same property.
